This website is operated by Joline Saunders. Throughout the site, the terms “we”, “us” and “our” refer to Joline Saunders.  Joline Saunders offers this website, including all information, tools and services available from this site to you, the user, conditioned upon your acceptance of all terms, conditions, policies and notices stated here.

SECTION 6 – ACCURACY OF BILLING AND ACCOUNT INFORMATION

 

We reserve the right to refuse any order you place with us. We may, in our sole discretion, limit or cancel quantities purchased per person, per household or per order. These restrictions may include orders placed by or under the same customer account, the same credit card, and/or orders that use the same billing and/or shipping address. In the event that we make a change to or cancel an order, we may attempt to notify you by contacting the e-mail and/or billing address/phone number provided at the time the order was made. We reserve the right to limit or prohibit orders that, in our sole judgment, appear to be placed by dealers, resellers or distributors.

 

You agree to provide current, complete and accurate purchase and account information for all purchases made at our store. You agree to promptly update your account and other information, including your email address and credit card numbers and expiration dates, so that we can complete your transactions and contact you as needed.

If paying a monthly subscription you agree to pay the full purchase price over the installments and any failure to pay will result in all services being suspended. Non-payments will be followed up through the necessary channels to ensure payment in full.

We may provide you with access to third-party tools over which we neither monitor nor have any control nor input.

 

You acknowledge and agree that we provide access to such tools ”as is” and “as available” without any warranties, representations or conditions of any kind and without any endorsement. We shall have no liability whatsoever arising from or relating to your use of optional third-party tools.

 

Any use by you of optional tools offered through the site is entirely at your own risk and discretion and you should ensure that you are familiar with and approve of the terms on which tools are provided by the relevant third-party provider(s).

You agree that from time to time we may remove the service for indefinite periods of time or cancel the service at any time, without notice to you.

In no case shall Joline Saunders, employees, affiliates, agents, contractors, interns, suppliers, service providers or licensors be liable for any injury, loss, claim, or any direct, indirect, incidental, punitive, special, or consequential damages of any kind, including, without limitation lost profits, lost revenue, lost savings, loss of data, replacement costs, or any similar damages, whether based in contract, tort (including negligence), strict liability or otherwise, arising from your use of any of the service or any products procured using the service, or for any other claim related in any way to your use of the service or any product, including, but not limited to, any errors or omissions in any content, or any loss or damage of any kind incurred as a result of the use of the service or any content (or product) posted, transmitted, or otherwise made available via the service, even if advised of their possibility. Because some states or jurisdictions do not allow the exclusion or the limitation of liability for consequential or incidental damages, in such states or jurisdictions, our liability shall be limited to the maximum extent permitted by law.

 

SECTION 14 – INDEMNIFICATION

 

You agree to indemnify, defend and hold harmless Joline Saunders and ourparent, subsidiaries, affiliates, partners, officers, directors, agents, contractors, licensors, service providers, subcontractors, suppliers, interns and employees, harmless from any claim or demand, including reasonable attorneys’ fees, made by any third-party due to or arising out of your breach of these Terms of Service or the documents they incorporate by reference, or your violation of any law or the rights of a third-party.

 

SECTION 15 – SEVERABILITY

 

In the event that any provision of these Terms of Service is determined to be unlawful, void or unenforceable, such provision shall nonetheless be enforceable to the fullest extent permitted by applicable law, and the unenforceable portion shall be deemed to be severed from these Terms of Service, such determination shall not affect the validity and enforceability of any other remaining provisions.

 

SECTION 16 – TERMINATION

The obligations and liabilities of the parties incurred prior to the termination date shall survive the termination of this agreement for all purposes.

 

These Terms of Service are effective unless and until terminated by either you or us. You may terminate these Terms of Service at any time by notifying us that you no longer wish to use our Services, or when you cease using our site.

 

If in our sole judgment you fail, or we suspect that you have failed, to comply with any term or provision of these Terms of Service, we also may terminate this agreement at any time without notice and you will remain liable for all amounts due up to and including the date of termination; and/or accordingly may deny you access to our Services (or any part thereof).

 

SECTION 17 – ENTIRE AGREEMENT

 

The failure of us to exercise or enforce any right or provision of these Terms of Service shall not constitute a waiver of such right or provision.

 

These Terms of Service and any policies or operating rules posted by us on this site or in respect to The Service constitutes the entire agreement and understanding between you and us and govern your use of the Service, superseding any prior or contemporaneous agreements, communications and proposals, whether oral or written, between you and us (including, but not limited to, any prior versions of the Terms of Service).

 

Any ambiguities in the interpretation of these Terms of Service shall not be construed against the drafting party.

These Terms of Service and any separate agreements whereby we provide you Services shall be governed by and construed in accordance with the laws of 3 Main Street, Adlestrop, Moreton in Marsh, GL56 0UN.

SECTION 21 – HYPNOTHERAPY & NLP TERMS AND CONDITIONS

Terms and Conditions for hypnotherapy services

  1. By signing up to work with Joline Saunders you are agreeing to these Terms and Conditions.
  2. The terms and conditions below apply to all hypnotherapy and coaching services provided by Joline Saunders to any individual or organisation (“the client”) and constitute a contract for the service to be provided by Joline Saunders for the client. The term coaching refers to personal coaching. In return for the fees payable by the client, Joline Saunders agrees to provide the service as described below and in accordance with the terms and conditions set out below. The client agrees to pay fees for the service on the terms and conditions set out below.
  3. The date that the first hypnotherapy session takes place on shall be deemed to be the start date for the service. Participation by any individual in the first hypnotherapy session constitutes acceptance of these terms and conditions. The client agrees to these terms and conditions by checking the box at payment for these services.

Responsibilities:

  1. Joline Saunders will seek to enable the client to set and achieve goals that will help bring about the desired outcomes for the client. The client has sole responsibility for any decisions they make following hypnotherapy wih Joline Saunders. Joline Saunders accepts no liability for the client’s actions. Joline Saunders has no liability for any loss incurred by any client, whether financial or otherwise, following commencement of hypnotherapy sessions, or for any perceived failure by the client, whether justified or otherwise, to achieve a material improvement in quality of life or to achieve their desired outcomes or goals.

Confidentiality:

  1. Personal information or business information supplied to Joline Saunders by the client in hypnotherapy sessions will be treated as confidential. It will not be disclosed to a third party without the client’s prior permission, save where required by law.
  2. Joline Saunders and the client will be required to sign a confidentiality agreement at commencement of hypnotherapy. Joline Saunders will respect the client’s privacy and seek written permission before disclosing they are a client.
  3. All documentation and information relating to the client will be held according to the Data Protection 1998, except as permitted by the client in writing or as required by law.

Hypnotherapy and coaching procedure:

  1. The Joline Saunders schedule will be arranged between Joline Saunders and the client. Joline Saunders will recommend the frequency of hypnotherapy and coaching sessions based on a professional assessment of the client’s requirements. This recommendation, or plan, is not binding and may be altered and adjusted throughout the hypnotherapy and coaching journey by mutual agreement, in accordance with the terms set out in this agreement.
  2. The number of hypnotherapy and coaching sessions will be agreed at the start of the hypnotherapy and coaching between Joline Saunders and the client, and confirmed by Joline Saunders by email or written correspondence. Where no specific number is agreed sessions will be provided on a session by session basis. Due to the nature of coaching, the initial term usually recommended is four sessions. Full payment is due before or at the first session. Additional sessions can be booked thereafter.
  3. The length of each session is usually 1 hour but can be agreed between Joline Saunders and the client at the commencement of the session (the initial session will usually be longer).
  4. Hypnotherapy and coaching will take place between the client and Joline Saunders, via Skype/Google or by telephone (client calls Joline Saunders) or face to face. Face-to-face sessions will take place in the office of Joline Saunders or at a mutually agreed venue. Where sessions takes place at a mutually agreed venue the client will be liable for any costs incurred by Joline Saunders. Unless otherwise agreed, the client is responsible for telephoning Joline Saunders at agreed times.
  5. Joline Saunders may assign the client tasks or exercises to complete between sessions. There is no obligation on the client to complete these tasks, but not doing so may slow the client’s progress in gaining improved quality of life or achieving desired business or personal outcomes. Where possible, clients are requested to submit any information requested by Joline Saunders relating to assignments at least 24 hours before the session when they are to be discussed. Joline Saunders will provide feedback on completed assignments during sessions.
  6. The client may contact Joline Saunders by phone (07768 865999) or email (jo@jojohypno.co.uk) between sessions to share a success or seek clarification on a hypnotherapy or coaching issue. Support between sessions is seen by Joline Saunders as a necessary part of the process. Joline Saunders will always advise a client in advance if the nature of a client’s contact is likely to incur an additional charge, and no such charges will be imposed without the client’s agreement.

Cancellation & Rearranging Sessions:

  1. If the client needs to rearrange a session, they should provide at least 24 hours’ notice. No refunds will be given to clients for unused sessions unless 24 hours’ notice has been given. In exceptional circumstances Joline Saunders may need to rearrange a session they will endeavour to give at least 48 hours’ notice. In these circumstances Joline Saunders will use reasonable endeavours to provide a satisfactory alternative appointment for the client.
  2. Where a client pays for a session, or sessions, in advance they must have the session(s) that they have paid for within 6 months of the payment, or their fee is forfeited.
  3. The client may terminate their coaching contract at any time in writin. Refunds on payments made against future sessions will be at the discretion of Joline Saunders.
  4. In exceptional circumstances, such as illness or unavailability due to bereavement or other commitments, inappropriate behaviour by the client, actual or potential conflict of interest, or other reasons, Joline Saunders can decide to terminate the service to the client early or refuse or be unable to provide further coaching sessions to the client. In such a circumstance the client will be given reasonable notice of termination by Joline Saunders where practicable, and
  5. There may be occasions when Joline Saunders may recommend to the client that they seek an alternative service more suited to their current needs. In this event Joline Saunders will fully discuss the reasons for the recommendation with the client. It is the client’s sole responsibility to decide whether to follow the recommendation and Joline Saunders does not accept any liability for the outcome of any decisions the client chooses to make.
